Physical Presence Audit Standards

How IRCC Calculates Your 1,095 Physical Presence Days

Under the Citizenship Act, physical presence is strictly enforced based on actual calendar days physically spent inside the borders of Canada. Even minor calculation errors can result in an application being returned or refused.

1. Permanent Resident Days

Each day physically present in Canada as a Permanent Resident counts as 1 full day toward your 1,095-day requirement.

2. Pre-PR Temporary Days

Days spent in Canada on a valid Work Permit, Study Permit, or Visitor Visa within the 5-year window count as 0.5 day per day (up to max 365 days).

3. Days Spent Outside Canada

Any day spent outside Canada for vacation, work travel, or family visits is completely deducted from your total presence count.

4. Income Tax Filing Check

You must have filed Canadian income taxes for at least 3 tax years within the 5-year period preceding your application date.

Frequently Asked Questions — Canadian Citizenship

Regulatory facts compiled by Elnaz Imani, RCIC #R526618.

Under Citizenship Act Subsection 5(1), permanent residents must accumulate at least 1,095 physical presence days (3 full years) inside Canada during the 5 years immediately preceding the date of signing and submitting their application.
Yes. Each day physically present in Canada as a temporary resident (on a valid study permit, work permit, or visitor status) within the 5-year eligibility window counts as half a day (0.5 day), up to a maximum total credit of 365 days.
Applicants between the ages of 18 and 54 on the date of application must demonstrate Canadian Language Benchmark (CLB) level 4 or higher in English or French (speaking and listening) and pass the 20-question Canadian Citizenship Knowledge Test based on the official Discover Canada study guide.
If a child is born outside Canada to at least one Canadian citizen parent (who was a citizen at the time of birth), the child may automatically derive Canadian citizenship at birth under Section 3 of the Citizenship Act. Filing an application for a Citizenship Certificate provides official government documentation and allows applying for a Canadian passport.
If IRCC suspects travel history gaps or discrepancies in physical presence days, they issue a Residence Questionnaire (RQ) demanding comprehensive corroborating evidence, including lease agreements, employment records, bank statements, utility bills, and official CBSA entry/exit records. Elnaz Imani, RCIC, assists in assembling complete audit-proof RQ response packages.
